Tender Description:

This bidding project, the earthwork and rock excavation works near Beniani village under the China Railway 23rd Bureau Group Georgia Branch's North-South Corridor Highway Project, meets all requirements for subcontracting tendering with construction funds secured. It is now subject to public bidding.

The qualification review is conducted on a post-qualification basis.

2. Project Overview and Scope of Tendering

  • Project Name: Earthwork and rock excavation works near Beniani village for the Georgia North-South Corridor Highway Project.
  • Construction Location: Sviani Rostiani, Dusheti Municipality (Khadas Kheoba), Georgia
  • Construction Funding Status: The construction funds have been secured.
  • Project Scale: Approximately 800,000 cubic meters (800,000 BCM; BCM denotes naturally compacted cubic meters, representing the volume of undisturbed natural formation in the original stratum).
  • Scope of the Tender: The scope of this tender covers the excavation, loading, transportation, lawful disposal, and full-process environmental management of remaining earth and rock materials within the aforementioned area. This tender shall be managed through specialized subcontracting; bidders shall assume full responsibility for the entire process from excavation to complete lawful disposal of such materials. The tenderer shall not relieve bidders of their quality, safety, environmental protection, and compliance responsibilities due to any circumstances arising during the process.
  • Project timeline: Provisionally set at 21 months. Scheduled commencement date is August 1, 2026, and scheduled completion date is April 30,2028 (the actual start date shall be subject to instructions issued by the project team).
  • Quality Requirements: Bidders shall strictly comply with all applicable Georgian laws, regulations, and technical specifications to complete the entire project, and assume a quality assurance responsibility of no less than 12 months for the long-term stability and environmental safety of the slag disposal site. Specific requirements are detailed in the tender documents.

3. Qualification Requirements for Bidders

3.1 General Qualification Requirements

  • The bidder shall be a corporate entity legally registered in Georgia or possessing valid business operating qualifications in the country, and must hold a valid business license.
  • The bidder must possess the capacity to independently assume civil liability.
  • Bidders must possess a good commercial reputation and not be listed on the list of dishonest judgment debtors.

3.2 Qualification Requirements

  • Bidders must possess a valid road transport operation license and professional contracting qualification for foundation engineering (or an equivalent transport operation license issued by Georgia).
  • Copy of the Work Safety License (or a transport operation license with equivalent validity in Georgia)
  • The bidder shall provide documentation proving its capability to fulfill this contract.
  • Bidders must possess valid tax registration certificates and qualify as VAT taxpayers.

3.3 Special Qualification Requirements for Disposal and Treatment (Key Clauses)

  • The bidder shall provide at least one set of basic information for the proposed slag disposal site in the tender documents (including name, location, GPS coordinates, ownership certificate or lease agreement, and written approval document for disposal issued by the municipal authority).
  • Upon winning the bid, the bidder shall submit, within 15 working days after contract signing, the formal waste disposal agreement signed with the slag disposal site owner and the land use permit documents for the site (in a notarized Georgian version).

3.4 Financial Requirements

  • Bidders must maintain sound financial standing and have no consecutive losses during the past three years (2023–2025).
  • Bidders shall submit audited financial statements for the past three years (balance sheet, income statement, cash flow statement) prepared by an accounting firm, or provide financial documentation recognized by the Georgian tax authorities.
  • The bidder shall possess working capital or available credit lines amounting to no less than 30% of the contract estimated price to meet project operational requirements.

3.5 Performance Requirements

  • The bidder must have undertaken or be currently executing at least one similar earthwork transportation and disposal project within the past three years (from January 1, 2023 to the bid submission deadline). Provide scanned copies of contract agreements (for ongoing projects, submit the contract; for completed projects, submit both the contract and completion acceptance/disposal completion certificate).
  • For similar projects, valid supporting documents such as contract agreements, completion acceptance certificates, or power consumption completion certificates must be provided.

3.6 Equipment and Personnel Requirements

  • Transportation Equipment: Bidders shall possess or lease (with a lease intent agreement provided) no fewer than 20 legally compliant transport vehicles. All vehicles must have valid registration certificates, insurance policies, and annual inspection certificates. Effective anti-leakage and dust-control measures (e.g., tarpaulin covering or sealed enclosures) must be implemented on the vehicles.
  • Project Lead: The bidder shall designate one project lead responsible for coordinating with the tenderer and overseeing on-site management. The project lead must possess at least two years of experience in managing similar projects.
  • Environmental Management Personnel: The bidder shall commit to appointing or designating one environmental management personnel responsible for overseeing environmental compliance at the site.

3.7 Reputation Requirements

  • The bidder shall have no record of major violations of laws or regulations within the past three years, nor any administrative penalties imposed for environmental issues.
  • The bidder shall provide a written undertaking stating that, within the past three years, there have been no contract breaches, engineering quality incidents, or safety accidents attributable to its own fault.
  • The bidder shall not be listed on the supplier blacklist maintained by the tenderer or the project owner.

3.8 Other Requirements

This project does not accept bids from consortia, and subcontracting or assignment of contracts is prohibited.

3.9 Special Compliance Requirements for Georgia

The bidder shall undertake to comply with all applicable laws and regulations of Georgia, including but not limited to:

(1) The Georgian Environmental Assessment Act
(2) The Georgian Waste Management Code
3) Relevant regulations issued by the municipal administrative authority at the project site regarding the disposal of earth and rock materials

The bidder shall undertake to comply with Georgia's traffic regulations during transportation, including restricted hours, speed limits, and route restrictions.
